The Janata Party President Dr.Subramanian Swamy, today appeared before the Delhi High Court Bench of Justice Vijendra Jain and Justice Rekha Sharma to seek Writ of Mandamus issued to the Election Commission to amend the Symbol Order to make the allotted election symbol equivalent to the trade mark, insignia or court of arms.
According to Dr.Subramanian Swamy who argued the case himself in person, the Trade Mark Act makes the trade mark given to companies permanent. In the same way the Janata Party which has used the “Chakra-Haldhar” symbol for the last 30 years continuously has become vitally associated with that symbol, which thus becomes equivalent to the trade mark of the Party. When Dr.Swamy pointed out that if the symbol of a political party becomes de-reserved, it may be then allotted by the Returning Officer to other candidates of a political party and hence place the original party in great disadvantage, the Bench enquired of Dr.Swamy whether he knew of any such instance, Dr.Swamy replied in the affirmative and thereupon the Bench said “You have not made it a party of the pleadings”. Thereupon Dr.Swamy asked for time for amending the Writ Petition to include instances where symbol of a party has been allotted to other parties. The bench then fixed March 6, 2006 as the next date of hearing.

The US Ambassador David Mulford’s remarks on the linking of India’s vote at IAEA Board meeting on Iran and the Indo-US nuclear deal have been unfairly rubbished by the Indian media and knee-jerk over-reactions of some Indian political parties. Based on the complete statement (published in today’s Hindu) it is clear that the Ambassador had merely stated what the US Congress reaction and Nuclear Suppliers Group would be in the event of India not voting with the US and other nuclear weapon states on the Iran nuclear issue. This he has a right to do in India, as the US Ambassador to India, even in un-orthodox way. He is providing an assessment that we need to take into account.
There is little doubt that India has to vote on the Iran nuclear issue on out understanding of our national interests. But nevertheless choices have to be made. If Iran is indeed violating or likely to violate it’s obligation under the Non Proliferation Treaty then India has to vote to make Iran comply with the Treaty. We have to stop running with the hares and hunting with the hounds as in the past. An aspiring World power should not do that.

STATEMENT MADE BY DR.SUBRAMANIAN SWAMY, JANATA PARTY PRESIDENT IN CHENNAI ON JANUARY 25, 2006
1. I welcome the possible formation of a JD(S)-BJP coalition government by Kumaraswamy in Karnataka as a healthy development for democracy in the country. It is a forerunner for the re-unification in a front of all those forces which came together in 1977 to oust a corrupt dictatorial Congress from power. Democracy would not have returned to India if the Janata Party had not been formed and had won the elections then. Today we have a highly corrupt Congress led government too, which has already shown acute dictatorial tendencies in the fiascos in Goa, Jharkhand and Bihar. The sychophancy shown in Hyderabad AICC meet is similar to the Guwahati AICC of 1976 when it was said “India is Indira”. So also are all the rigged media polls that we hear today.
2. It is surprising that the DMK leader Karunanidhi, who despite not attending a single day of the Assembly, has found time to rush to the Governor to demand that the State takeover of his family’s cable companies are stalled by the Governor. It is morally irresponsible. Moreover, it is a conflict of interest and a breach of his oath of office on part Dayanidhi Maran, a Union Minister of Telecommunications, to accompany him to the Raj Bhavan to make this plea. I demand that Maran resign his Ministership, and Karunanidhi quit his Assembly seat for breach of democratic norms.
3. In the forthcoming Assembly polls, the JPB has approved the call of the Janata Party unit in Tamil Nadu to seek allies and form a front on the election plank of Hindustan Nadu. Hindustan Nadu means that all Indians are Hindus or those who accept that their ancestors were Hindus and later converted. Hence, the call will be that change of religion does not mean change of Hindu culture. Hindustan Nadu concept also means that castes of Hindus cannot be decided by birth but, as Krishna Bhagwan and rishis have repeatedly said, is based on gunas [inclinations]. Dr. Ambedkar also stated the same in his Columbia University research as far back as 1916. That is why Valmiki, Veda Vyasa, Kalidasa, and Vishvamitra though were not born of Brahmin parents but are regarded as great rishis, while Ravana is considered a Brahmin gone wrong.
4. The statement of Rahul Gandhi that his religion is the flag is inane and ridiculous. No wonder he could not pass his exams after his father as Prime Minister had got him admission for undergraduate studies at Harvard. Hence, he has betrayed the memory of his father by agreeing to an electoral alliance with those organizations that praise the killers of his father. His Catholic foreign mother sports a big vermillion mark on her forehead and dresses in a sari only as Ravana dressed as a sanyasi to fool and abduct Sita. The nation should beware these two imposters.
5. I am welcome the VHP’s decision to hold a massive rally in Erode on March 19th for Hindu Resurgence and for the sake of grama pujarigal village temple priests] welfare. All Hindustan--minded Tamils must fully participate and contribute to the success of this rally.
6. Fostering such a consciousness is necessary for unity of communities.

Following the censure contained in the Constitution Bench judgment of the Supreme Court today regarding the illegal dissolution of the Legislative Assembly of Bihar, holding the Governor and Union Council of Minister led by the Prime Minister equally culpable in recommending the said dissolution, there is no democratic alternative left for the Governor and Prime Minister to submit their resignations. In the case of the Governor, his action has been held to be malafide, and in the case of the Prime Minister it is clearly implied that he is guilty of dereliction of his obvious duty to verify and assess a Governor’s report before forwarding it for signature to the President. In other words [ obviously under the thumb of Ms. Sonia Gandhi], Dr. Manmohan Singh has failed to apply his mind on the issue and hence unfit to be Prime Minister. In the background of the Mitrokhin Archives, Volcker Committee Report and the Quattrocchi scandal, there is no hope for the country but for an early toppling of the UPA government on the Karnataka precedent.

STATEMENT OF JANATA PARTY PRESIDENT DR.SUBRAMANIAN SWAMY MADE IN MADURAI ON JANUARY 9, 2006
1. The sharply rising cases of rape of defenceless and helpless girls requires now drastic remedy. I suggest two steps: first, those males committing rape must be held to be suffering from a mental disorder, and hence a law must be passed in Parliament that these males must be punished by surgery and castration. Second, all schools and colleges must make compulsory for girl students to learn self-defence martial arts.
2. The United States government has decided to encourage students in schools and colleges to learn Sanskritised Hindi as one of the seven important world languages. It is a matter of Dravidian Movement's most stupid decisions to remove Hindi teaching from Tamil Nadu educational system. This has harmed Tamils in getting good jobs in other parts of India. I am not in favour of making Hindi learning as compulsory, but it should be made an optional language along with Sanskrit, and other Indian languages. Recently, I had UP CM Mulayam Singh Yadav, and he agreed with me that Tamil should be taught in UP schools. I am again going to Lucknow on January 11-13 and will pursue the matter.
3. A Third Front in Tamil Nadu to protect Hindu values, and pursue pro-people economic policies, will be formed before the next Assembly elections. I am in touch with BJP and other parties in this regard. I have also urged the prominent Hindu religious leaders in the State to support such a front. The people will be asked to choose between "Om Shakti" and "Rome Bhakti".
4. The terrorist attack in Bangalore [Bengaluru] is a clear indication that the UPA soft appeasing approach towards terrorism is hurting the country. The Union government acknowledges that the terrorists attacking the nation are ISI-financed and Pakistan trained. The government also claims that there are 126 training camps in PoK, and 36 such camps in Bangla Desh run by the ISI. Moreover, it is also admitted by the government that all the terrorists groups present in India are co-ordinating their activities and helping each other in training of cadres. Yet pro-terrorist political parties are part of the UPA government. From Kashmir to Kanyakumari, the target is the innocent hapless Hindu.
5. I demand therefore that the UPA government give up it’s present disastrous appeasement and formulate an effective counter terrorist policy. In particular:
[a] It must re-enact the repealed POTA.
[b] It must not negotiate with any terrorist group that does not surrender first
[c] It must follow the policy of hot-pursuit and airforce bombing of camps outside the country
[d] It must aid, with safeguards, those SAARC countries that seek our assistance to combat terrorism in their own country
[e] It must reach an understanding with China and Israel to cooperate in anti-terrorist in intelligence and operations.
6. I congratulate the VHP for deciding to hold a Hindu Protection massive rally in Erode on March 18th.
7. In Karnataka, the Janata Party has made significant gains in the local bodies elections [see enclosed press clipping]. I have proposed to my old friend Deve Gowda that he break with Congress and form a Janata Front government with the help of the BJP. This is the only way to save Bengaluru from terrorism.

STATEMENT OF DR. SUBRAMANIAN SWAMY, JANATA PARTY PRESIDENT AND FORMER UNION MINISTER MADE IN TIRUCHI ON JANUARY 8, 2006
1. I am in Tiruchi to attend the VHP workers meeting in connection with the proposed massive rally in Erode on March 18th for the Hindu Protection Conclave. Tamil Nadu people need to awake to the danger that Hindu religion is now facing from an international conspiracy. Terrorism, narcotics, unbridled globalization, and targeting of India’s holy personages are part of that conspiracy. Ms. Sonia Gandhi, who has told many lies about herself and betrayed the memory of Rajiv Gandhi’s martyrdom by aligning with those parties that praise the LTTE, is the nodal point of this international conspiracy. Therefore, Tamil Nadu now urgently needs a pro-Hindu Third Front.
2. Former External Affairs Minister, Mr.Natwar Singh should not take submissively his unceremonious dumping [being removed from the Congress Working Committee] by Ms. Sonia Gandhi. Instead he should become ‘a whistle blower’ in the national interest. Taking money from the terrorist dictator, Saddam Hussein, by accepting oil vouchers is a heinous anti-national act that should be exposed. Moreover, not a drop of the allotted oil came to oil-starved India but instead went to Italy through subsidiaries of Masefield AG company. If Mr. Singh performs this national duty, then opposition parties will stand up for him.
3. The fact that neither former diplomat Rajeshwar Dayal nor former judge Pathak have come up even after ten weeks with a single document that shows that Congress had been impersonated in receiving oil vouchers shows that Ms. Sonia Gandhi as Congress CEO is liable and prima facie guilty. I demand now the CBI act on my complaint filed on December 7, 2005, and register a FIR with Ms.Sonia Gandhi as the principal accused. Thereafter, through the Interpol, the CBI can cooperate with the Swiss authorities who are investigating the Masefiled company and the L/C issuer Vitol.
4. Sri Lanka is on the verge of renewed civil war. India should not militarily assist the Sri Lanka government unless two pre-conditions are met by that government. First, the Lanka government must now unilaterally implement an India-type devolved Constitution, loosely called a federal Constitution. This will satisfy the Tamils. Second, the Lanka government permit India to have in Colombo a cantonment area for two divisions of Indian troops and a squadron of the IAF so that Sri Lanka will not be able to betray India as President Premadasa did in 1989.
5. The TN CM Ms.Jayalalitha, according to uncontradicted media reports, made the Centre cancel President Rajapakshe’s proposed visit to Chennai. This was, it is said, to appease the pro-LTTE parties in the state. This action was retrograde and cowardly on part of the Chief Minister. Why should she have been afraid when DMK nominee in the Union Ministry, T.R.Balu did not feel ashamed to meet the Sri Lanka President?

The Janata Party condemns and demands the withdrawal of the decision of the UPA Union Cabinet to cut by 30% the PDS subsidy and hence increasing prices of grains sold in nation shops for those above poverty line families, as well as to reduce the allocation by 15 kgs for these nation card holders above the poverty line families; and by 5 kgs for those below in poverty line.
This has been done to obtain as Rs.4,524 crores in revenue, and thereby save the UPA from its budgetary bankruptcy. Mr.Chidambaram tenure as Finance Minister (1997-98 & 2005-05) is directly responsible for this trend toward bankruptcy. He has allowed fiscal deficit to rise above the danger mark of 9 percent of GDP, to 13% of GDP. In 1996, fiscal deficit was only 6% of GDP.
The people should now know the hollowness and insincerety of Ms.Sonia Gandhi’s 2004 campaign slogan: Congress ka haath Aam Aadmi ke Saath” [Congress hand symbol is for the common man].
In stead, Chidambaram has proved that Congress hand is that of a pick-pocket of poor people or of a strangler.
